Agreement to Terms

Welcome to GermanyVPS.com. By accessing or using this website, you agree to be bound by these Terms of Service and our Privacy Policy, which together govern the relationship between you and QuadSpark IT Solutions Private Limited, operating as Host4Fun ("Host4Fun", "we", "us", or "our").

By using any Host4Fun / GermanyVPS.com products or services, you ("you", "your", "Client", "Customer", or "Subscriber") agree to comply with all policies, rules, and guidelines set forth herein.

Host4Fun reserves the right to modify these Terms of Service at any time, with or without notice. It is your responsibility to review these terms periodically. Continued use of our services following any changes constitutes acceptance of the updated terms. Failure to comply may result in suspension or termination of services.

General Use

All content on this website is provided for general information and use only, subject to change without notice.
We make no warranties or guarantees regarding the accuracy, performance, or completeness of any information or materials provided.
Your use of any information or materials is entirely at your own risk.
We shall not be liable for any loss or damage arising from declined transactions due to card limits or authorisation failures.

Service Deployment & Availability

Activation Times

Web Hosting: Instant
Germany VPS: Up to 24 hours (typically 2–4 hours)
Dedicated Server: 24–48 hours (typically under 10 hours)

Service Level Agreement (SLA): Best effort basis. Uptime guarantee: 99%.

Data Backup

Host4Fun does not provide automatic data backup by default. Backup services are available as a paid add-on and are performed manually. Once a VPS or web hosting service is terminated, data recovery is not possible. You are solely responsible for maintaining independent backups of your data.

Prohibited Activities

The following activities are strictly prohibited and may result in immediate suspension or termination of your Germany VPS service:

Denial of Service (DoS) attacks
Port scanning
TOR services
Illegal downloads or piracy
Nulled scripts
Copyrighted content without authorisation
Cryptocurrency mining
Spam-related services or mass emailing
Any email services (Port 25 is blocked by default)
Disk I/O abuse
Excessive system load (OpenVZ load over 3)
CPU, memory, or network abuse — you may not use 100% CPU 24/7
Torrent usage

Content Restrictions

Child pornography is strictly prohibited and will be reported to authorities immediately.
Phishing, scam, or shock content is forbidden.
You may not host copyrighted material without proper authorisation.

Network Routing and Connectivity

Network connectivity is provided on a best-effort basis. We do not guarantee specific network routes, latency, throughput, or performance to any geographic location or international destination. Routing paths are determined by our upstream carriers, peering partners, and overall internet conditions, which are outside our direct control.

Optimal or direct routing between the client's local ISP and our network is not guaranteed. Performance may be affected by the client's ISP, intermediary networks, regional congestion, or government-imposed restrictions — such conditions are not considered a service fault or outage.

Bandwidth Policy

If your allocated bandwidth is exhausted, it resets at the end of the billing cycle. Additional bandwidth may be purchased. All plans include generous bandwidth allocations (2TB–16TB depending on plan) with no per-GB overage fees within the allocated amount.

VPS & OS Policies

Custom ISO is allowed for VPS plans above 1GB RAM (not available during special promotions).
Windows Server is provided with a 180-day evaluation licence only.
All services are unmanaged — you are responsible for system administration, security hardening, and software support.

IP Address Policy

IP addresses are not changed or swapped for free. IP change is available for a one-time fee of $5.
Each VPS retains its assigned IP for the billing term.
rDNS is not available.
Additional IPs are not available for VPS products.
We do not guarantee "fresh" or whitelisted IPs.

Billing & Payments

Chargebacks or payment disputes result in immediate service suspension.
If not resolved within 24 hours, services are terminated without refund.
We may provide transaction details to payment processors to contest fraudulent disputes.

Service Fees

VPS location change: $5 (one-time)
VPS migration with data: $10 (one-time)
Reactivation after abuse: $15–$50+

Affiliate Program Terms

To participate in the Host4Fun Affiliate Program:

You must operate an active website.
Referrals are credited when a visitor clicks your affiliate link and completes a sign-up.
Coupon or deal-sharing websites are not permitted.
You may not use your own affiliate link for personal use.
Black-hat SEO, spam, or unethical promotion methods are prohibited.
You must clearly disclose your affiliate relationship with Host4Fun.
You must comply with all applicable laws and regulations.

Refund Policy

We offer a 24-hour refund window only for Shared Web Hosting and VPS with a valid reason. All approved refunds are subject to 25%–30% deployment/payment fees plus non-refundable transaction charges.

Payments via local/regional gateways (bKash, Paytm, Airtel Money, Bank Transfer, GCash, DragonPay, Globe GCash, QIWI, Alipay, WebMoney)

Additional Refund Conditions

Refunds are not granted if support has already been provided via tickets, live chat, or email.
Inability to connect due to local ISP restrictions, firewalls (e.g., GFW), or regional network limitations does not qualify for a refund.
Discrepancies in IP geolocation do not qualify as a valid refund reason.
PayPal and all transaction fees are non-refundable.
We are not responsible for access to any third-party websites.
Users are responsible for reviewing their orders before confirmation. We are not liable for accidental or mistaken orders.
All refunds, if applicable, are processed at our sole discretion.

SLA Credit Schedule

If monthly uptime falls below the guaranteed service level, you may request service credits in accordance with the schedule below. Credits are not applied automatically — a request must be submitted within 7 days of the reported downtime.

Manual Verification

Accounts subject to manual verification must provide requested documents. Failure to do so will result in termination and may incur service charges.

DMCA & Copyright

Upon receipt of any DMCA or copyright complaint, it will be forwarded to you. You must immediately remove the infringing content or your service will be terminated without refund.

Support

Support is not available 24/7. Tickets are typically answered within one working day (usually within 1–4 hours). Support covers hardware issues, network problems, and datacenter infrastructure. OS-level issues, software configuration, and application support are the customer's responsibility as this is an unmanaged service.

Breach of Terms

If you violate these Terms of Service, Host4Fun may take any action deemed appropriate, including suspending or terminating your account, blocking access, contacting your ISP, or initiating legal proceedings. All decisions are at our sole discretion.
